If you have been found guilty of a criminal offence, you have a criminal record. A criminal record is not removed automatically. To have your record removed, you must make an application under the Criminal Records Act of Canada for a pardon. The Act is intended to benefit persons who have been convicted of offences and have later rehabilitated themselves. A pardon is a formal process to remove the stigma associated with a criminal record.


ELIGIBILITY

You are eligible to apply for a pardon 3 or 5 years after you have completed your sentence for your offence(s). A sentence may be a fine, costs, surcharges, restitution or compensation orders in the past 15 years. This would also include any probation time or a jail term. For the purposes of a pardon, a court order which prohibits you from driving or possessing a firearm is not considered as part of the sentence. For summary offences, pardon eligibility is after 3 years; for indictable offences, eligibility is after 5 years.


PARDON PROCESS

We will compile the necessary personal information. We will then create a computer file specific to your case, complete all the necessary forms, and present them to you to sign. These forms will be used to obtain the documents required prior to petitioning for a pardon.

Once all the information is collected, we will petition the National Parole Board (NPB) for a pardon on your behalf. The NPB is empowered to grant, deny or revoke pardons. As your representative, we will receive and handle all communications from the NPB and other agencies.

Our service will track the progress of your case and will promptly send out follow-up letters whenever a response or document is not received within the normal time frame. Our proactive role and familiarity with the process will ensure all the documents required are obtained in a timely manner and that your case is processed expeditiously. We will keep you informed at each stage of the process. Normally, it takes 16-20 months from the time the application is filed with the NPB.
